Language from State Rep. Daisy Morales’s Commercial Telephone Solicitation Bill in CS/SB 1120 headed to Governor’s desk
TALLAHASSEE, Fla. Today, State Senator Audrey Gibson’s (D-Jacksonville) Commercial Telephone Solicitation bill (CS/SB 1120) to curtail unwanted sales calls, which includes language from State Representative Daisy Morales’s (D-Orlando) Commercial Telephone Solicitation bill (HB 857), headed to the Florida House of Representatives and passed on the Florida House floor.
Language from State Rep. Morales’s bill as amended on April 19, 2021 defines unlawful acts and practices for solicitation calls.
Amendment:
A commercial telephone seller or salesperson may not make any of the following types of phone calls, including calls made through automated dialing or recorded messages:
(a) A commercial telephone solicitation phone call before 8 a.m. or after 8 p.m. local time in the called person’s time zone.
(b) More than three commercial telephone solicitation phone calls from any number to a person over a 24-hour period on the same subject matter or issue, regardless of the phone number used to make the call.
Language from Representative Morales’s HB 857 was amended into Representative Mike Beltran’s (R-Lithia) Telephone Solicitation bill (CS/CS/HB 1307) in the House, however it was eventually CS/SB 1120, which also included the language, that passed the legislature.
CS/SB 1120 is now headed to the Governor’s desk. If signed, the law will go into effect July 1, 2021.
“I proudly support and advocate for stronger legislation that will prevent unnecessary and unwanted telephone solicitation calls,” Morales has said. “People have a right to be at peace.”
